Welcome to Tamarindo Credit LLC ("Tamarindo"). These Terms of Service ("Terms") govern your access to and use of Tamarindo's websites, mobile applications, APIs, software, communications and related services (collectively, the "Platform"). By creating an account, clicking "Create My Account," or otherwise using the Platform, you agree to these Terms.
1. Eligibility
You represent that you are at least 18 years old, have legal capacity, and that all information you provide is accurate and complete.
2. Our Services
The Platform facilitates residential, automotive, leasing, mortgage, financing and related financial opportunities. Depending on the product and jurisdiction, Tamarindo may act directly or through affiliates or Financing Partners in one or more capacities, including technology provider, platform operator, referral source, marketplace, originator, broker, lessor, lender, servicer, administrator or other lawful participant. Nothing in these Terms guarantees approval or availability of any product.
3. Account
You are responsible for safeguarding your credentials and all activity under your account. Notify us promptly of unauthorized use.
4. Information
You retain ownership of information you submit. You grant Tamarindo a limited license to use it to operate the Platform, provide Services, improve products, prevent fraud, comply with law and as described in the Privacy Policy.
5. Identity Verification
We may verify your identity and information using lawful sources to protect users, prevent fraud and satisfy regulatory obligations.
6. Consumer Reports
Creating an account does not authorize Tamarindo or any Financing Partner to obtain a Consumer Report. A separate Consumer Credit Report Authorization will be presented before any Consumer Report is requested.
7. Communications
You consent to receive operational communications electronically. Marketing communications are governed by your separate communication preferences and may be withdrawn at any time.
8. Acceptable Use
You agree not to misuse the Platform, submit false information, interfere with security, violate applicable law, or infringe the rights of others.
9. Intellectual Property
The Platform and all related software, content, trademarks and technology are owned by Tamarindo or its licensors.
10. Third Parties
The Platform may interact with Financing Partners and other service providers. Their products and services may be governed by separate terms.
11. Disclaimers
The Platform is provided 'AS IS' and 'AS AVAILABLE' to the fullest extent permitted by law.
12. Limitation of Liability
To the fullest extent permitted by law, Tamarindo shall not be liable for indirect, incidental, consequential, punitive or special damages. Aggregate liability shall not exceed the greater of US$250 or amounts paid by you to Tamarindo during the preceding twelve months.
13. Indemnification
You agree to indemnify Tamarindo and its affiliates against claims arising from your breach of these Terms or misuse of the Platform.
14. Suspension
We may suspend or terminate access for fraud, legal compliance, security concerns or material violations of these Terms.
15. Governing Documents
These Terms incorporate the Privacy Policy. Registration is governed by the Registration & Marketing Consent, and any Consumer Report is governed by the separate Consumer Credit Report Authorization.
16. Governing Law
These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
17. Miscellaneous
If any provision is unenforceable, the remainder survives. These Terms constitute the agreement regarding use of the Platform together with the incorporated documents.
